To qualify for an HSA, an individual must be covered under an HDHP and may not be covered by any other non-HDHP health plan. An exception allows for “certain permitted insurance or other permitted coverage.” But prescription drug plans are health plans, and prescription drug benefits are not listed as permitted insurance or permitted coverage. So, an individual who is covered by an HDHP that does not cover prescription drugs and who is also covered by a separate prescription drug plan (or rider) that provides benefits before the HDHP deductible is met may not participate in an HSA. If the separate prescription drug plan (or rider) does not provide benefits until the participant meets the HDHP’s minimum annual deductible, or if the prescription drug plan is part of an HDHP and subject to the minimum annual deductible, the individual may participate in an HSA. This is not the guidance that employers were hoping for, but Revenue Procedure 2004-22 does provide transition relief from the above ruling until December 31, 2005.
